Having a professional, ethical mortgage broker working to protect your interests in critical. Unfortunately I found out the hard way. Since becoming a licensed mortgage broker I have refinanced two of my own homes, my homestead that I occupy with my husband, and a rental that I lived in when I was single.

When we purchased the homestead property we repeatedly requested that I was not to be on the mortgage note and was only to be on the deed. We did not want the financial liability on both our credit reports. However, I was put on the mortgage note and not on the deed! Only with refinancing was I able to be removed from the mortgage note.

It turned out that this was the least of my problems. An attorney selected by the buyer at the time of our original purchase failed to insure that the home equity line on the property was closed. The seller paid off the equity line but never closed it. Four years later when refinancing we find that there is a $22,000.00 lien on our property! The seller knowingly used an open line of credit on a property he had sold! The banks response - we'll remove the lien when the account is paid in full and closed. I received little if any assistance from the closing attorney, title insurance company, or bank. I had to locate the seller myself and was finally able to resolve the issue before losing my rate lock.
